Welcome to the Community resource page for the 2010 FEMA map update process.  St. Clair County Communities will have received letters indicating an update to their regulations is required.  Your individual letters should indicate which section of the regulation applies to your community.  Each community who has participated in the program will have already adopted an earlier version of the regulations and a method of enforcement; the community may only be required to copy and resubmit their regulations.  Communities who are yet to participate in the program may elect to submit some general information along with regulations to enforce the appropriate component of section 60.3

Although this information may seem overwhelming; the Michigan Building Code incorporates all the required language and regulations.  Communities must simply ensure a method for keeping records of development actions within a flood zone and enforce the Michigan Building Code.  For communities who are required to preserve a floodway; the Michigan Waterways Commission has a requirement to undertake this responsibility; a community could simply allow them to undertake the requirement.

 

While there are no laws in place which require a community to participate in this program, our community residents may be required to obtain insurance on structures within the mapped special hazard area.  These insurance rates are directly attributed to the participation level of the local unit of government:

  • Residents in a non-participating community would obtain private flood insurance.
  • Residents in a participating community will qualify for federally backed flood insurance.
  • Communities offering select services may qualify residents for discounts
  • Communities adopting regulations beyond the minimum may provide percentage discounts.

 

For your convenience, many of the related text references have been replaced by the language indicated.  Your letter will indicate which section would apply to your community based on the available map data. You may click on the regulation section heading for more details on the requirements. St. Clair County appears to have communities within the following classifications:

 

Regulations for 60.3 (B)

These regulations apply if FEMA has designated areas of special flood hazards (A zones) by the publication of a community's FHBM or FIRM, but has neither produced water surface elevation data nor identified a floodway or coastal high hazard area.

 

Regulations for 60.3 (C)

These regulations apply if FEMA has provided a notice of final flood elevations for one or more special flood hazard areas on the community's FIRM and, if appropriate, has designated other special flood hazard areas without base flood elevations on the community's FIRM, but has not identified a regulatory floodway or coastal high hazard area.

 

Regulations for 60.3 (D)

These regulations apply if FEMA has provided a notice of final base flood elevations within Zones A130 and/or AE on the community's FIRM and, if appropriate, has designated AO zones, AH zones, A99 zones, and A zones on the community's FIRM, and has provided data from which the community shall designate its regulatory floodway.
